The employer pays in any case (at least for every progrom that I've ever heard of.)
If the test is positive, and the employee chooses to have a re-test by a lab of his own choosing, then that is paid for by the employee (with possible reimbursement, depending upon results.)
There is usually also the choice of a re-hab program for those employees who test positive, as an alternative to being summarily discharged.
